Mr. Wagner has testified ninety-three times at trial. He has testified in federal courts in sixteen different states and in state court in ten different states. The most frequent subject matters of his expert testimony are the calculation of commercial damages or business value. He has also testified a number of times on the subject of alter ego. In addition, Mr. Wagner has testified twenty six times in alternative dispute resolution forums.
Mr. Wagner has acted as an arbitrator in a number of commercial arbitrations based on his extensive business consulting experience and his legal training. His expertise is sought after in arbitrations that have either complicated damages or business valuation issues. He has acted as an arbitrator for the American Arbitration Association, NASD, and the Arbitration Services of Portland, Inc. Mr. Wagner's consulting experience ranges over most of the major industries in the United States over the last twenty-eight years. He has particular expertise in high technology and biotechnology. One of his principal focuses has been on determining the economic value of intellectual property, including patents, copyrights, trademarks, and trade secrets.
In addition to his experience at InteCap, Mr. Wagner has held senior roles in two national consulting firms and was a partner for a Big Four accounting firm. Mr. Wagner has previously served on a number of committees at both the AICPA and the California Society of CPAs relevant to his professional expertise. He is the author or co-author, of over twenty-five professional publications, and is the co-editor of the Litigation Services Handbook, Third Edition published by John Wiley & Sons. Mr. Wagner is a frequent speaker on the topics of damages and expert witness services at national and state conferences.
