Originally intended to cover potential shortfalls in Social Security and to spread the benefits of private ownership, ESOPs have been impacted by these turbulent times. Pending legislation and comments from both political parties about these arrangements mean that business executives, business valuation experts, and attorneys need to understand the realities of structuring and valuing ESOPs.
